Second Offense DUI Penalties in Pennsylvania

Blood Alcohol Level .08% – .099% or Refusal: GENERAL IMPAIRMENT

  • Considered an ungraded misdemeanor.

  • Minimum of 5 days in jail, up to 6 months.
  • 1-year license suspension.
  • Ignition Interlock required for 1 year

Blood Alcohol Level .10% – .159%: HIGH RATE OF ALCOHOL

  • Includes:
    • MINORS WITH .02% B.A.C. or Greater
    • C.D.L. DRIVERS WITH .04% B.A.C. or Greater
    • SCHOOL BUS DRIVERS WITH .04% B.A.C. or Greater
    • ACCIDENT with Damage or Injury
  • Considered an ungraded misdemeanor.
  • Means you will have a criminal record.
  • Minimum of 30 days in jail, up to 6 months.
  • 1-year license suspension.
  • Ignition Interlock required for 1 year
  • Minimum of $750 fine, up to $5,000.
  • Alcohol Highway Safety School.
  • Alcohol Treatment when ordered.
  • Drug & Alcohol Assessment
  • C.R.N. Evaluation.
  • House Arrest eligible.
  • Possible restitution if you caused property damage.

Blood Alcohol Level .16% + or Controlled Substances found in your system: HIGHEST RATE
