In Bucks County, Restrictive Probation is a court-ordered sentence that places significant limitations on an individual’s freedom while still allowing them to serve their sentence outside of prison. Restrictive probation typically involves more rigorous monitoring and stricter compliance requirements than standard probation. Failure to adhere to these restrictions can result in a probation violation, which may lead to a harsher sentence or even incarceration.
Who is eligible for Bucks County Restrictive Probation?
Bucks County Restrictive Probation Program is now offered through Bucks County Adult Probation and is only available to non-violent offenders. This program allows you to remain in the community while participating in treatment. It also allows you to continue working and attend all necessary appointments.
There is an application process required for restrictive probation with Bucks County Adult Probation and Parole. When applying, you must provide all the required evaluation/assessment and treatment documents along with your application, or it will not be considered. A Bucks County Adult Probation supervisor will review your application to determine if you are acceptable for the program. The process does not end there. Eligibility for the program does not mean that you will automatically be sentenced to home confinement instead of jail.
For most DUI cases, a period of time on home confinement with GPS monitoring will be required. Where you reside will also determine if you are eligible for the program. If you reside outside of Bucks County, you may not be eligible for the program depending on where you live. What happens if I am eligible for Restrictive Probation?
If you are eligible by Bucks County Adult Probation and Parole, the next step requires that a judge approves your Restrictive Probation at sentencing. If sentenced to Restrictive Probation, you will be placed on probation for an average of 24 months. Many cases will require that you be placed on probation for an even longer period based upon the charge for which you are being sentenced. There may be a possibility for early termination of restrictive probation. This could happen only in certain cases of good behavior, where all of your conditions have been completed and you have paid off all of your fines and court costs.
The Bucks County Restrictive Probation Program requires you to maintain your sobriety, engage in substance abuse and/or mental health treatment if deemed necessary, undergo frequent and random drug testing, adhere to a curfew, attend regular visits with your probation officer, and obtain and maintain employment. You may also be required to have the Sobriety Monitoring and Reporting Technology (S.M.A.R.T.) Mobile or Breath Check device, which monitors your blood alcohol content randomly. There is a cost associated with GPS monitoring, and you will be required to make regular payments.
